Article 1 - Scope

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, apply without restriction or reservation to all sales concluded by the seller with consumer or non-professional customers, hereinafter referred to as the “Customer”, wishing to purchase products offered for sale on trinityin.myshopify.com, hereinafter referred to as the “Website”.

The Website sells products intended for wellness, relaxation and improving home comfort. The products offered may include air humidifiers, aroma diffusers, flame-effect diffusers, massage devices, massage guns, neck and shoulder massagers, and various accessories related to comfort and home aromatherapy.

The main characteristics of the products, including specifications, illustrations, dimensions, capacities and usage instructions, are presented on the product pages of the Website. The Customer must read them before placing an order.

The choice and purchase of a product are the sole responsibility of the Customer. Product offers are valid as long as they are displayed on the Website, subject to availability.

These Terms are available at any time on the Website and shall prevail over any conflicting document.

The Customer confirms that they have read and accepted these Terms before validating their order.

Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Customer.

The products displayed on the Website are offered for sale in the following territories: European Union, Switzerland, United Kingdom and United States of America.

For any order delivered outside mainland France, the Customer is considered the importer of the product(s) concerned. Customs duties, local taxes, import duties or state taxes may be payable. These costs are the sole responsibility of the Customer, unless otherwise stated on the Website.


Article 2 - Prices

Products are supplied at the prices displayed on the Website at the time the order is validated.

Prices are displayed in euros. They include applicable taxes where VAT applies. If the Seller benefits from the French VAT exemption scheme, VAT is not applicable under Article 293 B of the French General Tax Code.

The Seller reserves the right to modify prices at any time. However, products will be invoiced based on the prices displayed when the order is validated.

Prices do not necessarily include processing, shipping, transport and delivery fees. Where applicable, these fees are displayed to the Customer before final validation of the order.

The total amount due by the Customer corresponds to the price of the products ordered, plus any delivery fees and additional costs clearly indicated before payment.


Article 3 - Orders

The Customer selects the product(s) they wish to order and adds them to the shopping cart.

Before validating the order, the Customer may review the details of the cart, modify quantities, remove a product or correct their information.

The Customer then enters their personal details, delivery address and, where applicable, billing address. The Customer selects the delivery method offered on the Website and checks the order summary.

Validating the order implies full acceptance of these Terms.

Payment is then made online using the payment methods offered on the Website. The order is considered final once payment has been validated.

Once the order is confirmed, the Customer receives a confirmation e-mail summarising the order details. The Seller then processes the order and arranges shipment as soon as possible.

The Customer is responsible for checking the accuracy of the order and must immediately report any error to customer service.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

The Customer may request cancellation of the order within 24 hours of order validation, provided that the order has not already been processed or shipped. If the order has already been processed or shipped, cancellation cannot be guaranteed. The Customer nevertheless retains their legal right of withdrawal under the conditions set out in these Terms.


Article 4 - Payment terms

The price is paid via secure payment methods offered on the Website, including bank card and any other payment method available at the time of the order.

Payment is due immediately when the order is validated.

Payment data is processed securely by the payment service provider(s) used by the Website. The Seller does not have access to the Customer’s full bank card details.

Payments made by the Customer are considered final only after actual receipt of the amounts due.

The Seller is not required to ship the products ordered if the Customer has not paid the full price under the conditions set out above.


Article 5 - Delivery

Products are delivered to the address provided by the Customer when placing the order.

Deliveries are carried out by an independent carrier or a third-party logistics provider. The Customer must provide a complete, accurate and accessible address. The Seller shall not be held liable for any delay or failed delivery resulting from incorrect or incomplete information provided by the Customer.

Delivery times are expressed in business days from order validation and may vary depending on the destination country, carrier, customs checks, busy periods or any event beyond the Seller’s control.

Unless otherwise specified, in the event of product unavailability or special circumstances, products ordered are delivered in a single shipment.

If the products ordered are not delivered within the announced timeframe, the Customer may ask the Seller in writing to deliver within an additional reasonable period. If delivery still does not take place within this additional period, the Customer may request cancellation of the sale under the applicable legal conditions.

In the event of cancellation of the contract due to non-delivery, amounts paid by the Customer will be refunded as soon as possible and no later than 14 days following the date of cancellation of the contract.

The risk of loss or damage is transferred when the Customer physically takes possession of the products.

The Customer must check the condition of the products upon delivery. Any delivery-related complaint, including damaged parcel, missing product, order error or defective product received, must be sent to the Seller by e-mail at deezlowin@gmail.com

The Customer must provide the order number, name, a description of the issue and, where necessary, photographs of the product or parcel concerned.


Article 6 - Transfer of ownership

Ownership of the products is transferred from the Seller to the Customer only after full payment of the price by the Customer, regardless of the delivery date.


Article 7 - Right of withdrawal

In accordance with the rules applicable to distance contracts, the consumer Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.

To exercise the right of withdrawal, the Customer must notify the Seller of their decision by means of a clear and unambiguous statement, by e-mail to deezlowin@gmail.com or by post to the address indicated in Article 1 of these Terms.

The Customer may use the withdrawal form attached to these Terms, although this is not mandatory.

Products must be returned in their original condition, complete, undamaged, clean and, where possible, in their original packaging with any accessories and instructions. Products that are damaged, incomplete or show signs of excessive use may be subject to a reduction in refund or refusal of refund where their condition results from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product.

Return shipping costs remain the responsibility of the Customer, except in the case of a non-compliant or defective product or an error attributable to the Seller.

The refund will be made within 14 days from receipt by the Seller of the returned products, or from the Customer providing proof of return shipment, whichever occurs first.

The refund will be made using the same payment method as the one used for the order, unless otherwise agreed between the parties.


Article 8 - Seller’s liability - Legal guarantees

Products sold on the Website benefit from the applicable legal guarantees, including:

  • the legal guarantee of conformity;
  • the legal guarantee against hidden defects.

The Customer may rely on these guarantees when a product is defective, damaged, not in line with the order or unfit for the usual use expected of a similar product.

To exercise their rights, the Customer must inform the Seller in writing, by e-mail to deezlowin@gmail.com, stating the order number, the nature of the issue and, where useful, attaching photographs or supporting evidence.

When the defect is confirmed and falls within an applicable legal guarantee, the Seller will, depending on the case, repair, replace or refund the product concerned within a maximum period of 30 days following confirmation of the defect.

Return costs relating to a product recognised as non-compliant or defective will be covered by the Seller according to the instructions provided to the Customer.

The Seller shall not be held liable in the following cases:

  • misuse of the product by the Customer;
  • use contrary to instructions, manuals or recommendations;
  • negligence, lack of maintenance, accident or normal wear and tear;
  • professional use where the product is intended for domestic use;
  • force majeure;
  • non-compliance with the legislation of the country in which the product is delivered, which the Customer is responsible for checking.

Photographs, illustrations and visuals displayed on the Website are not contractual and may slightly differ from the product received, provided that this does not affect the essential characteristics of the product.


Article 9 - Personal data

The Customer is informed that the collection of personal data is necessary for processing the order, selling the products, payment, delivery, customer service and compliance with the Seller’s legal obligations.

The personal data collected may include: first name, last name, e-mail address, phone number, delivery address, billing address, order information, payment information, delivery information and exchanges with customer service.

Personal data may be transmitted to service providers required for the execution of the order, including:

  • transport providers;
  • payment providers;
  • e-commerce platform;
  • Website host;
  • suppliers or logistics providers;
  • applications required for the operation of the store;
  • order management and customer service tools.

The data controller is the Seller, whose details are provided in Article 1 of these Terms.

Unless the Customer gives express consent, personal data is not used for advertising or marketing purposes.

Data is kept for the period necessary to process the order, provide customer service, comply with legal, accounting and tax obligations, and defend the Seller’s rights.

The Seller implements reasonable security measures to protect personal data against loss, unauthorised access, alteration or disclosure.

In accordance with applicable data protection regulations, the Customer has the right to access, rectify, object to, erase, restrict and, where applicable, request portability of their personal data.

The Customer may exercise these rights by contacting the Seller by e-mail at: deezlowin@gmail.com.

Certain data may nevertheless be retained where retention is necessary to comply with a legal, accounting or tax obligation.

The Customer may also lodge a complaint with the CNIL if they believe that their rights have not been respected.


Article 10 - Intellectual property

The content of the Website, including texts, images, photographs, graphics, logos, visual elements, structure and presentation, is protected by intellectual property laws.

Any reproduction, representation, modification, publication, adaptation or exploitation of all or part of the Website content, by any means whatsoever, is prohibited without the Seller’s prior written authorisation.


Article 11 - Applicable law and language

These Terms are governed by French law.

These Terms are drafted in French. If they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.


Article 12 - Complaints, mediation and disputes

For any complaint, the Customer may contact the Seller’s customer service using the contact details provided in Article 1 of these Terms.

In the event of a dispute, the Customer must first submit a written complaint to the Seller in order to attempt to resolve the matter amicably.

In accordance with the rules applicable to consumer mediation, the consumer Customer may use a consumer mediator free of charge in order to seek an amicable resolution of the dispute.
